Ius Omnibus files class action to defend consumers harmed by EDP

On September 6, the Competition, Supervision and Regulation Court received a popular action filed by the consumers’ association Ius Omnibus. The claim is against an abuse of dominant position by EDP Produção, already declared and sanctioned by the Portuguese Competition Authority. EDP’s abuse of dominant position caused damage to consumers living in mainland Portugal.Part of the damages have already been compensated by the Government, through the CMEC review mechanism, however, the Advisory Board of the Portuguese Attorney General’s Office (“Procuradoria Geral da República”) has stressed that the popular action procedure could be used to get the remaining part of the compensation.
